The Constitutional State and its Crisis

Abstract
The article focuses on the model of so-called “constitutional State”, prevailing in many countries with mature democratic institutions. After presenting a silhouette it highlights two relevant aspects of its crisis: weakening of political parties and resizing of welfare State. On the background there are relationship and tension between constitutionalism and rights and between constitutionalism and democracy.
